Welcome to Eternal Voice. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Escapesean ("Eternal Voice", "we", "us", or "our") governing your access to and use of the Eternal Voice platform, website, and services (collectively, the "Service").

By creating an account, uploading content, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately stop using the Service.

1. Service Description

Eternal Voice is a SaaS platform that enables users to create AI-powered conversational clones inspired by WhatsApp conversations. The Service includes:

  • Analysis and processing of WhatsApp conversations (text and audio messages)
  • AI voice cloning using advanced machine learning technology (ElevenLabs Instant Voice Cloning)
  • Interactive conversations within our web application (text and voice messages)
  • Pay-per-use pricing model with a free trial included at account creation

The Service uses third-party technologies including OpenAI GPT-4o, OpenAI Whisper, ElevenLabs, and other service providers to deliver its functionality.

1.1 Important Understanding: AI Nature of the Clone

YOU EXPRESSLY ACKNOWLEDGE AND UNDERSTAND THAT:

  • The AI clone created by Eternal Voice is an artificial intelligence system, not a real person.
  • The clone is inspired by the voice, personality, and communication patterns of a real individual, but it is not an exact copy or replica of that person.
  • The clone operates using machine learning algorithms and generates responses based on patterns learned from the uploaded conversations—it does not possess consciousness, emotions, true memories, or the actual thoughts of the real person.
  • The quality and accuracy of the AI clone depends entirely on the quantity and quality of data you provide. Eternal Voice does not guarantee perfect replication of personality, voice, emotional tone, or conversational style.
  • Interactions with the clone are simulated conversations and should not be treated as genuine communication with the real individual.
  • The clone may produce responses that are inaccurate, inappropriate, out-of-character, or unintended, as AI systems can generate unpredictable outputs.

By using this Service, you acknowledge that you are interacting with an AI simulation, not a real person, and that this distinction may have emotional, psychological, or practical implications for you.

2. Eligibility and Account

2.1 Age Requirement

You must be at least 18 years of age to use the Service. By creating an account, you confirm that you meet this requirement.

2.2 Account Creation

  • One account per email address.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate and complete information during registration.
  • You agree to notify us immediately of any unauthorised use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in prohibited activities. You may delete your account at any time via your dashboard.

3. Clone Creation Limits (MVP Phase)

During our initial launch phase:

  • Each account is limited to creating 1 AI clone.
  • You may delete and recreate your clone once (to account for errors or improvements).
  • Multi-clone functionality will be available in a future update.

Reason for Limit: Creating AI clones incurs significant computational costs. This limit helps us maintain service quality and affordability during our MVP phase.

4. Consent and Legal Requirements

4.1 Your Attestation

By uploading a WhatsApp conversation or audio files to create an AI clone, you explicitly represent, warrant, and confirm that:

  • You own the rights to all uploaded content, or you have obtained all necessary permissions.
  • You have obtained explicit, informed consent from the individual whose voice and personality are being cloned (or from their legal representatives if the individual is deceased or incapacitated).
  • Your use of the Service does not violate any person's intellectual property rights, privacy rights, publicity rights, or any other legal rights.
  • You comply with all applicable laws and regulations in your jurisdiction, including UK data protection law.

4.2 Your Sole Responsibility

You are solely and entirely responsible for:

  • Obtaining all necessary consents and permissions.
  • Ensuring your use of the Service is lawful.
  • Any legal consequences arising from your use of the Service.
  • Understanding that the clone is an AI simulation, not the real person, and managing your expectations accordingly.

4.3 Indemnification

You agree to indemnify, defend, and hold harmless Eternal Voice, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Your use or misuse of the Service.
  • Content you upload or actions you take using the Service.
  • Any emotional, psychological, or personal harm you experience from interacting with an AI clone.

Eternal Voice does not verify consent and relies entirely on your good faith representations.

5. Prohibited Uses

You agree NOT to use the Service to:

  • Clone any person's voice or personality without their explicit consent.
  • Impersonate, harass, defraud, threaten, or harm any person or entity.
  • Create content that is illegal, defamatory, obscene, pornographic, or promotes violence or hate.
  • Violate any applicable law, regulation, or third-party rights.
  • Upload content containing malware, viruses, or harmful code.
  • Attempt to reverse-engineer, hack, or circumvent security measures of the Service.
  • Resell, redistribute, or sublicense access to the Service without our written permission.
  • Use the Service for any commercial purpose that competes with Eternal Voice.
  • Misrepresent the AI clone as the actual person or use it to deceive others.

Violation of these prohibitions will result in immediate account termination and may be reported to law enforcement.

6. Data, Privacy, and Security

6.1 Data Collection

To provide the Service, we collect and process:

  • WhatsApp conversations (text and audio).
  • Personalisation form responses.
  • Payment information (processed securely via Stripe; we do not store card data).
  • Usage logs and operational metadata necessary to run the Service (e.g., message counts for billing, timestamps, and system logs).

6.2 Third-Party Processing

Your data is processed by the following third-party services:

  • OpenAI (GPT-4o for conversation generation, Whisper for audio transcription).
  • ElevenLabs (voice cloning and text-to-speech synthesis).
  • Supabase (secure database storage).
  • Stripe (payment processing).

6.3 Data Deletion

All sensitive data (WhatsApp conversations, audio files, form responses) are permanently and automatically deleted immediately after your AI clone is created.

Only the following are retained:

  • AI model parameters (personality profile, voice model).
  • Your account information.
  • Payment history.

6.4 Your Data Rights (UK GDPR)

Under UK data protection law, you have the right to:

  • Access your personal data.
  • Correct inaccurate data.
  • Delete your data (right to be forgotten).
  • Request portability of your data.
  • Object to certain processing.

7. Payments and Refunds

7.1 Pricing Model

Eternal Voice operates on a pay-per-use basis:

  • Free trial included with every new clone (limited messages).
  • Credit packs available for purchase to extend usage.
  • All prices are displayed in GBP (£) and processed securely via Stripe.

7.2 Refund Policy

  • Refunds are available: Before your AI clone is created.
  • No refunds after: Your AI clone has been successfully created (the service has been delivered).
  • Unused credits: Non-refundable but remain on your account indefinitely.

7.3 Right of Withdrawal (UK Consumer Rights)

You have the right to cancel within 14 calendar days of purchase, provided:

  • The clone has not been created or delivered.
  • You have not started using the service.

To withdraw, email eternalvoiceuk@gmail.com with your purchase date. Refunds will be processed within 14 days of notification.

7.4 Payment Processing

All payments are processed by Stripe. We do not store your credit card information. By purchasing credits, you agree to Stripe's Terms of Service.

8. Intellectual Property

8.1 Eternal Voice Ownership

All aspects of the Service—including the website, platform interface, logo, branding, source code, algorithms, and documentation—are the exclusive property of Eternal Voice and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

8.2 Your Content

You retain all ownership rights to the content you upload (WhatsApp conversations, audio files, etc.). By uploading content, you grant Eternal Voice a limited, non-exclusive, royalty-free licence to use, process, and analyse your content solely for the purpose of creating and operating your AI clone.

8.3 AI-Generated Content

Responses generated by your AI clone are produced by artificial intelligence. Eternal Voice does not guarantee the accuracy, appropriateness, or quality of AI-generated content. You are responsible for how you use and share such content.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Guarantees of uninterrupted, error-free, or secure operation.
  • Guarantees regarding the accuracy, quality, or emotional fidelity of AI clones.

9.2 No Guarantee of Results or Accuracy

Eternal Voice is a technology service that creates AI simulations. We do not guarantee that:

  • Your AI clone will perfectly or accurately replicate the personality, voice, speech patterns, beliefs, opinions, or emotional tone of the real individual.
  • The clone's responses will always be appropriate, in-character, or consistent with how the real person would respond.
  • Interactions with your clone will meet your emotional, personal, or psychological expectations.
  • The Service will be available at all times or free from technical issues.

The AI clone is inspired by real conversations but is not an exact copy. It is a computational approximation generated by machine learning algorithms.

9.3 Emotional and Psychological Disclaimer

YOU ACKNOWLEDGE THAT:

  • Interacting with an AI clone of a deceased, absent, or estranged loved one may cause emotional distress, grief, disappointment, confusion, or other psychological impacts.
  • Eternal Voice is a technology tool, not a mental health service, therapy, or substitute for professional counselling.
  • Eternal Voice is NOT responsible for any emotional, psychological, or mental health consequences arising from your use of the Service, including but not limited to:
    • Grief, sadness, or trauma triggered by AI interactions.
    • Unrealistic expectations about the clone's abilities or authenticity.
    • Dependence on or unhealthy attachment to the AI clone.
    • Disappointment with the quality or realism of the clone.

If you are experiencing grief, trauma, or mental health challenges, we strongly encourage you to seek support from a licensed mental health professional.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Eternal Voice SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
    • Emotional distress, grief, psychological harm, or mental anguish.
    • Loss of data, profits, or business opportunities.
    • Damages arising from unauthorised access, hacking, or data breaches beyond our reasonable control.
    • Any harm arising from your interactions with the AI clone or your misunderstanding of its nature.
  • Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to Eternal Voice in the 12 months preceding the claim.
  • In cases where you have only used the free trial, our liability is limited to zero.

10. Termination

10.1 Termination by You

You may delete your account at any time via your dashboard. Upon deletion:

  • Your AI clone and all associated data will be permanently deleted.
  • Any unused credits will be forfeited (non-refundable).
  • You may not create a new account without our permission if your previous account was terminated for violation of these Terms.

10.2 Termination by Eternal Voice

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms.
  • You engage in fraudulent, illegal, or abusive behaviour.
  • We receive a valid legal request or court order.
  • Your account poses a security risk to the Service or other users.

We will attempt to notify you via email, except in cases of immediate security threats or legal prohibitions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

  • Update the "Last Updated" date at the top of this page.
  • Notify you via email or through the Service.
  • Provide at least 14 days' notice before changes take effect.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of England and Wales, and you consent to the exclusive jurisdiction of such courts.

12.3 Dispute Resolution

We encourage you to contact us first to resolve any dispute amicably. Please email eternalvoiceuk@gmail.com with details of your concern. We will respond within 30 days.

If amicable resolution is not possible, disputes may be subject to alternative dispute resolution or proceedings in the English courts.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Eternal Voice regarding your use of the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13.3 No Waiver

Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or our right to enforce it in the future.

13.4 Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign these Terms to any successor or affiliate at any time.

By using Eternal Voice, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You further acknowledge that you understand the AI clone is a technological simulation inspired by—but not identical to—a real person, and that Eternal Voice is not responsible for any emotional or psychological consequences arising from your use of the Service.
